{"id":1692,"date":"2016-10-18T16:39:09","date_gmt":"2016-10-18T13:39:09","guid":{"rendered":"http:\/\/insanveinsan.org\/?p=1692"},"modified":"2018-04-09T21:57:16","modified_gmt":"2018-04-09T18:57:16","slug":"bir-siyaset-ve-hukuk-etigi-sorunu-olarak-1982-anayasasinin-iktidar-prangasi","status":"publish","type":"post","link":"https:\/\/www.insanveinsan.org\/en\/bir-siyaset-ve-hukuk-etigi-sorunu-olarak-1982-anayasasinin-iktidar-prangasi\/","title":{"rendered":"\u2018Shackles of Power\u2019 in the Constitution of 1982 as an Ethical Issue of Politics and Law"},"content":{"rendered":"<p><\/p>\n<p style=\"text-align: justify;\"><strong>Abstract: <\/strong> Formation of a corpus of (written) rules as a basis for organized public life, and in this wise the idea of preventing the arbitrary behavior of the governors and administrators could be considered one of the most important stages of the history of humanity.<br \/>\nConstitutionalist movement in the West is not only a movement through which each state could have a so-called formal constitution, on the contrary it aims to achieve a limited government bounded by the rule of law and supremacy of the constitution. In actuality, the dynamics of political life do not meet the constitutional norms. Generally, the \u2018documented results\u2019 of those historical developments take place in political and social life as an ethical issue of politics and law. Just that is the concrete and actual case of the majoritarian model which the Constitution of 1982 produced and transformed into current \u201cregime\u201d, so to say, a medallion around the neck of the constitution, just one side symbolizing the \u2018authority\u2019 while the other side \u2018democracy\u2019. It reflects authority as \u2018state power\u2019, and democracy as \u201cthe ballot box\u2019 which allows absolute numerical superiority to majority.<br \/>\nAs the \u201cidentity of the constitution\u201d, the design of political through which the values transferred into the law becomes concrete in social-political life. The fundamental question is whether \u201ccitizens\u201d can find themselves in that identity or not. The Constitution of 1982 responses that question as a \u201chomework\u201d for citizens, and \u201ctutelage\u201d for the political power.<br \/>\nThe article ultimately concentrate on the question how the shackles of power pathologically formed in the constitution and the ways to overcome those problems.<\/p>\n<p style=\"text-align: justify;\"><strong>Keywords: <\/strong> Constitution, Political power, Constituent assembly, Political system.<\/p>\n<h1> Bir Siyaset ve Hukuk Eti\u011fi Sorunu Olarak 1982 Anayasas\u0131n\u0131n \u2018\u0130ktidar Prangas\u0131\u2019 <\/h1>\n<p style=\"text-align: justify;\"><strong>\u00d6zet: <\/strong> \u00d6rg\u00fctl\u00fc toplum ya\u015fay\u0131\u015f\u0131n\u0131n temeli say\u0131labilecek bir yaz\u0131l\u0131 kurallar b\u00fct\u00fcn\u00fc meydana getirmek ve \u00f6zellikle bu yoldan y\u00f6neticilerin keyfi davran\u0131\u015flar\u0131n\u0131 \u00f6nlemek d\u00fc\u015f\u00fcncesi insanl\u0131k tarihinin \u00f6nemli a\u015famalar\u0131ndan biridir.<br \/>\nBat\u0131\u2019daki anayasac\u0131l\u0131k hareketleri sadece her devletin bir anayasas\u0131 olmas\u0131 \u015feklinde s\u00f6zde anayasac\u0131l\u0131k de\u011fil, anayasan\u0131n \u00fcst\u00fcnl\u00fc\u011f\u00fcn\u00fcn sa\u011flanmas\u0131yla anayasaya ba\u011fl\u0131 devlet fikrinin geli\u015fmesi y\u00f6n\u00fcnde olmu\u015ftur. Olgular\u0131n fiili durumu anayasal normlar\u0131n siyasi hayat\u0131n dinamikleriyle tam olarak b\u00fct\u00fcnle\u015fmesine imk\u00e2n vermemektedir.<br \/>\nGenellikle bu geli\u015fmelerin ortaya \u00e7\u0131kard\u0131\u011f\u0131 \u2018belgeli sonu\u00e7lar\u2019, bir siyaset ve hukuk eti\u011fi sorunu olarak siyasal-toplumsal ya\u015famda yer bulurlar. Bu hususun somut ve akt\u00fcel \u00f6rne\u011fi 1982 Anayasas\u0131n\u0131n \u00fcreterek \u201crejim\u201d haline d\u00f6n\u00fc\u015ft\u00fcrd\u00fc\u011f\u00fc \u2018\u00e7o\u011funluk\u00e7u model\u2019 olup, adeta anayasan\u0131n boynunda as\u0131l\u0131 duran bir madalyon gibi; bir y\u00fcz\u00fc ile \u2018otoriteyi\u2019, di\u011fer y\u00fcz\u00fc ile de \u2018demokrasiyi\u2019 simgelemektedir. Otorite olarak \u2018devlet iktidar\u0131n\u0131\u2019, demokrasi olarak mutlak say\u0131sal \u00fcst\u00fcnl\u00fc\u011fe olanak sa\u011flayan \u2018se\u00e7im sand\u0131\u011f\u0131n\u0131\u2019 ifade etmektedir.<br \/>\nDe\u011ferlerin hukuka aktar\u0131m\u0131n\u0131n siyasal tasar\u0131m\u0131 \u201canayasan\u0131n kimli\u011fi\u201d olarak toplumsal-siyasal ya\u015famda somutla\u015fmaktad\u0131r.
