Abstract: <\/strong> According to Article 67 of the 1982 Constitution, the election laws must be regulated in a manner that accommodates the principles of justice in representation and stability in administration. These principles work in the opposite direction. Therefore, electoral systems have preferred one of these two principles while the other compromises from the first. First of all, goals of election threshold implementation and to what extent these goals are achieved will be dwelled on this article. Then the constitutional amendment in the referendum held on 2017 how would affect these two functions, and whether the 10% electoral threshold would contribute to ensuring justice in representation are evaluated. It also examines the election alliances, which were adopted before the 24 June 2018 elections, how had an impact on the election threshold. It is concluded that the goals wanted with the election threshold are not fulfilled to a great extent and that the lack of the representation justice has negative effects on the voting activities of the voters and the election alliances have the potential to lift the election threshold.<\/p>\n

\u00d6z: <\/strong> 1982 Anayasas\u0131\u2019n\u0131n 67. maddesine g\u00f6re se\u00e7im kanunlar\u0131n\u0131n \u201ctemsilde adalet\u201d ve \u201cy\u00f6netimde istikrar\u201d ilkelerini ba\u011fda\u015ft\u0131racak \u015fekilde d\u00fczenlenmesi gerekmektedir. Bu iki ilke ters y\u00f6nde i\u015flemektedir. Bu nedenle se\u00e7im sistemleri bu ilkelerden birisini \u00f6ncelemekte, di\u011fer ilkeden ise taviz vermektedir. Bu \u00e7al\u0131\u015fmada \u00f6ncelikle \u00fclke se\u00e7im baraj\u0131 uygulamas\u0131 ile hangi ama\u00e7lara ula\u015f\u0131lmak istendi\u011fi, bu ama\u00e7lar\u0131n hangi \u00f6l\u00e7\u00fcde ger\u00e7ekle\u015fti\u011fi \u00fczerinde durulmu\u015f ve temsilde adalet ve y\u00f6netimde istikrar ilkeleri incelenmi\u015ftir. Sonras\u0131nda 2017 referandumu ile kabul edilen anayasa de\u011fi\u015fikli\u011finin se\u00e7im sisteminin bu iki i\u015flevine nas\u0131l etki edece\u011fi ve %10\u2019luk se\u00e7im baraj\u0131n\u0131n temsilde adaletin sa\u011flanmas\u0131na katk\u0131 sa\u011flay\u0131p sa\u011flamayaca\u011f\u0131 sorusuna cevap aranm\u0131\u015ft\u0131r. Ayr\u0131ca \u00e7al\u0131\u015fma kapsam\u0131nda 24 Haziran 2018 se\u00e7imleri \u00f6ncesinde kabul edilen se\u00e7im ittifaklar\u0131n\u0131n se\u00e7im baraj\u0131 \u00fczerinde nas\u0131l bir etki do\u011furdu\u011fu incelenmi\u015ftir. \u00c7al\u0131\u015fmada se\u00e7im baraj\u0131 ile ula\u015f\u0131lmak istenen ama\u00e7lara b\u00fcy\u00fck \u00f6l\u00e7\u00fcde ula\u015f\u0131lamad\u0131\u011f\u0131, temsil adaletinin sa\u011flanamamas\u0131n\u0131n se\u00e7menlerin iradesinin yasama faaliyetlerine yans\u0131mas\u0131 bak\u0131m\u0131ndan olumsuz etkileri oldu\u011fu ve se\u00e7im ittifaklar\u0131n\u0131n \u00fclke se\u00e7im baraj\u0131n\u0131 fiilen ortadan kald\u0131rma potansiyeline sahip oldu\u011fu tespit edilmi\u015ftir.<\/p>\n
