Abstract: <\/strong> The phenomenon of terrorism is known as a concept which is hardly defined in the national and international contexts. We come across with this difficulty in defining by laws the terrorist association, the acts which create the crime of terrorist association and the crimes of terrorism. In this study, the concept of the crime of terrorism as defined in the framework of Turkish Counter Terrorism Law is mentioned as the absolute crimes of terrorism and the relative crimes of terrorism. The first part of this study deals with the concept of the crime of terrorism and a general approach to the differences between the absolute crimes of terrorism and the relative crimes of terrorism. In the second part of this study, the absolute crimes of terrorism in the Turkish Penal Code – Disrupting the Unity and Integrity of the State, Destruction of Military Facilities and Conspiracy which Benefits Enemy Military Movements, Violation of the Constitution, Offences against the Legislative Body, Offences against the Government, Armed Revolt against the Government of Turkish Republic, Armed Organisation, Supplying Arms, Enlistment of Soldiers in Foreign Service, Assasionation of the President and the crime of terrorist organization- are examined according to the Turkish Counter Terrorism Law. The conceptual and legal framework of the relative crimes of terrorism is mentioned in the last part of the study.<\/p>\n

\u00d6z: <\/strong> Ter\u00f6r kavram\u0131 gerek ulusal gerekse uluslararas\u0131 ba\u011flamda tan\u0131mlanmas\u0131 g\u00fc\u00e7 bir kavram olarak bilinmektedir. Ayn\u0131 zorluk, ter\u00f6r \u00f6rg\u00fct\u00fc, ter\u00f6r ama\u00e7l\u0131 \u00f6rg\u00fctlenme su\u00e7u te\u015fkil eden fiiller ve ter\u00f6r su\u00e7lar\u0131n\u0131n kanuni tan\u0131mlar\u0131 hususunda da mevcuttur. Bu \u00e7al\u0131\u015fmada ter\u00f6r su\u00e7u kavram\u0131, mutlak ter\u00f6r su\u00e7u ve nispi ter\u00f6r su\u00e7u Ter\u00f6rle M\u00fccadele Kanunu \u00e7er\u00e7evesinde ele al\u0131nmaktad\u0131r. \u00c7al\u0131\u015fman\u0131n birinci b\u00f6l\u00fcm\u00fc, ter\u00f6r su\u00e7u kavram\u0131 ile mutlak ter\u00f6r su\u00e7u ve nispi ter\u00f6r su\u00e7u aras\u0131ndaki farklara y\u00f6nelik genel bir yakla\u015f\u0131ma yer vermektedir. \u00c7al\u0131\u015fman\u0131n ikinci b\u00f6l\u00fcm\u00fcnde T\u00fcrk Ceza Kanunu\u2019ndaki mutlak ter\u00f6r su\u00e7lar\u0131 – Devletin birli\u011fini ve \u00fclke b\u00fct\u00fcnl\u00fc\u011f\u00fcn\u00fc bozmak, asker\u00ee tesisleri tahrip ve d\u00fc\u015fman asker\u00ee hareketleri yarar\u0131na anla\u015fma, anayasay\u0131 ihlal, yasama organ\u0131na kar\u015f\u0131 su\u00e7, h\u00fck\u00fcmete kar\u015f\u0131 su\u00e7, T\u00fcrkiye Cumhuriyeti H\u00fck\u00fcmetine kar\u015f\u0131 sil\u00e2hl\u0131 isyan, silahl\u0131 \u00f6rg\u00fct, silah sa\u011flama, yabanc\u0131 hizmetine askere yazma, yaz\u0131lma ve Cumhurba\u015fkan\u0131na suikast- Ter\u00f6rle M\u00fccadele Kanunu \u00e7er\u00e7evesinde de\u011ferlendirilmektedir. Nispi ter\u00f6r su\u00e7lar\u0131n\u0131n kavramsal ve hukuki \u00e7er\u00e7evesi ise son b\u00f6l\u00fcm\u00fcn konusunu olu\u015fturmaktad\u0131r.<\/p>\n
