This situation only raises the institutional, normative and judicial side of law and makes it difficult to ask the philosophical ancient questions that reveal the question of law and the need for the philosophy of law: What is the source of the law and the concepts of justice, right, and freedom? Secondly, what is the source or basis of the legitimacy of the law? Both the question and answer to these two ancient questions are up to the philosophy of law. In this study, the importance of the philosophy of law will be emphasized in the solution of the problems caused by the legalist paradigm which is dominant in the perception of the law. First, we will touch upon the intersection of law with the morality in the natural law tradition. Then, we will emphasize the dilemmas of legal positivism. Bu durum, sadece hukukun kurumsal, normatif ve adli yan\u0131n\u0131 \u00f6ne \u00e7\u0131kart\u0131r ve hukukla ilgili sorular\u0131 ve hukuk felsefesine neden ihtiya\u00e7 duyuldu\u011funu a\u00e7\u0131\u011fa \u00e7\u0131karan felsefi kadim sorular\u0131 sormay\u0131 zorla\u015ft\u0131r\u0131rlar: Hukukun ve i\u00e7erdi\u011fi adalet, hak, \u00f6zg\u00fcrl\u00fck kavramlar\u0131n\u0131n kayna\u011f\u0131 nedir? \u0130kinci olarak da hukukun me\u015fruiyetinin kayna\u011f\u0131 veya dayana\u011f\u0131 nedir? Bu kadim iki sorunun hem sorulmas\u0131 hem de yan\u0131tlanmas\u0131, hukuk felsefesine d\u00fc\u015fer. Bu \u00e7al\u0131\u015fmada hukukun alg\u0131lan\u0131\u015f\u0131nda hakim olan yasalc\u0131 paradigman\u0131n yol a\u00e7t\u0131\u011f\u0131 sorunlar\u0131n \u00e7\u00f6z\u00fcm\u00fcnde hukuk felsefesinin \u00f6nemi vurgulanacakt\u0131r. \u0130lk olarak do\u011fal hukuk gelene\u011finde hukukun ahlak ile olan kesi\u015fimine de\u011finece\u011fiz. Daha sonra hukuksal pozitivizmin a\u00e7mazlar\u0131n\u0131 vurgulayaca\u011f\u0131z.
