Abstract: <\/strong>Adultery, which has been described as an ugly, haram, sin and immoral act in the eyes of societies, has been punished in various ways throughout the history. Penalties for adultery crimes vary according to the law of societies and morality of societies. Some societies have only condemned these adulterous, while others have punished them with the greatest punishment that can be given. In the Ottoman Empire, the crime of adultery, which is described as an action against the public morality, has been punished in accordance with the provisions of \u015fer\u2019i and \u00f6rfi laws. With the new criminal law in the 19th century, the penalties imposed on adultery were relatively changed. However, the implementation of religious provisions was continued due to the fact that \u015fer\u2019i courts continued their duties. In addition, \u201cthe woman who committed adultery and evil must have been killed related\u201d this fetva applyed. to the relatives who saw the woman and his accomplice in adultery and killed him, \u015fer\u2019i law and code don\u2019t punishment. Therefore, today\u2019s murders, called honor killings, have become happened in the Ottoman Empire, which dominated a wide geography.<\/p>\n

Zina su\u00e7una tatbik olunan cezalar, toplumlar\u0131n hukuk ve ahlak anlay\u0131\u015f\u0131na g\u00f6re de\u011fi\u015fiklik g\u00f6stermi\u015ftir. Baz\u0131 toplumlar, bu fiili i\u015fleyenleri sadece k\u0131namakla yetinirken baz\u0131lar\u0131ysa verilebilecek en b\u00fcy\u00fck ceza olan \u00f6l\u00fcmle cezaland\u0131rm\u0131\u015ft\u0131r. Osmanl\u0131 Devleti\u2019nde umumi ahlaka ayk\u0131r\u0131 bir eylem olarak nitelendirilen zina su\u00e7u, kayna\u011f\u0131 din olan \u015fer\u2019i hukuk ve \u00f6rfi kanunlar\u0131n h\u00fck\u00fcmlerine uygun olarak cezaland\u0131r\u0131lm\u0131\u015ft\u0131r. 19. y\u00fczy\u0131lda yeni ceza kanunnameleriyle birlikte zina su\u00e7una uygulanan cezalarda nispeten de\u011fi\u015fiklik olmu\u015f, ancak \u015fer\u2019i mahkemelerin g\u00f6revlerine devam etmelerinden kaynakl\u0131 olarak dini h\u00fck\u00fcmlerin uygulanmas\u0131na devam edilmi\u015ftir. Ayr\u0131ca zina ve bozgunculuk yapan kad\u0131n\u0131n \u00f6ld\u00fcr\u00fclmesi gerekti\u011fiyle ilgili olan fetvalar tatbik edilerek kad\u0131n\u0131 ve su\u00e7 orta\u011f\u0131n\u0131 zina halinde g\u00f6r\u00fcp \u00f6ld\u00fcren akrabalara, \u015fer\u2019en ve kanunen bir ceza verilmemi\u015f ve bu y\u00fczden g\u00fcn\u00fcm\u00fczde namus cinayetleri olarak adland\u0131r\u0131lan cinayetler, geni\u015f bir co\u011frafyaya h\u00fckmeden Osmanl\u0131 Devleti\u2019nde az\u0131msanmayacak derecede \u00e7ok vukua gelmi\u015ftir..<\/p>\n
